The 10-year U.S. Treasury yield is projected to rise from 2.92% at Thursday's close (down 0.06% from last week) to 3.374% (down 0.06% from last week) in one year. The 10-year U.S. Treasury yield in ten years is forecast to reach 4.639%, 1 basis point lower than last week. The 15-year fixed rate mortgage rate is forecast to rise from the effective yield of 3.69% on Thursday (down 0.001% from last week) to 4.222% (down 0.006% from last week) in one year and 6.29% in 10 years, up 0.038% from last week. How do you quantify and qualify what is cheap enough? To me, there's a big difference in relative cheapness in a company selling at 74% of NCAV versus one selling at 95%. I'm wondering if I'm putting too much weight on this cheapness measurement instead of acknowledging that any decent business selling at less than NCAV is cheap enough. Yet, one has to have some quantifiable idea of when something is not cheap enough anymore.

2. The products a company sells will still be in demand for years to come, because if they��e not then the past, which we know, does not tell us anything about the future, which we don��.
3. A company is financially strong enough to withstand the kinds of shocks companies typically experience bearing in mind some are more sensitive to events than others.
4. How to judge whether the share price undervalues the company, bearing in mind the preceding three factors.

As it turns out, many e-cig start-ups and even tobacco industry giant Lorillard (NYSE: LO ) �have infringed on these patents, possibly due to their rush getting e-cig products to market. So, six months on from closing the deal with Dragonite, Fontem Ventures, backed by Imperial Tobacco, has filed nine lawsuits in a federal court, asking the court to rule that the patents infringed were valid, and the defendants should pay as-of-yet unspecified damages. The companies Imperial is taking to court are Lorillard, NJOY, Vapor Corp., VMR Products LLC, Ballantyne Brands LLC, CB Distributors, Spark Industries LLC, Logic Technology Development LLC, FIN Branding Group LLC, Victory Electronic Cigarettes Corp. (NASDAQOTH: ECIG ) , and DR Distributors LLC. So, it would seem as if Imperial is intending to kill off the majority of its competition before many of them can even get much of a foothold in the market.

Is activist investing a force for good when it comes to shareholders? Recent events, namely the Bill Ackman-J.C. Penney (JCP) debacle, have left investors and analysts tired of the outspoken hedge-funders of the world. There are, of course, plenty of activists whose actions have enhanced not just their funds' portfolios, but those of passive, minority shareholders. They've forced companies to make positive changes -- to restructure, elect new board members, and get back on track toward healthier operations. Then again, others end up like J.C. Penney -- a seemingly lost business, rich with legacy yet left crippled by boardroom drama. That leaves us -- the average consumers and investors -- with a pressing question: Are these megaphoned power players trying to effect change that will benefit all, the company included? Or are they just after results that will juice their own returns? The Age of Activism While many activist investors consider themselves to be molded in the image of a certain Omaha-based super-investor, many of today's hedge fund superstars have taken a very different approach to the craft of identifying mispriced securities.
